An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bedding by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
Defence Research Development Canada (DRDC) Atlantic has a
requirement to design and fabricate an underwater magnetic
signature collection system which is essentially the array and
the associated interface components and connecting cables. DRDC
will be constructing a portable underwater magnetic check range
system in support of the Halifax Class Modernization Project.
This system will be used to measure the magnetic signature of
Canadian warships when they are deployed on operations around
the world. The core component of the check range system is a
lightweight underwater array. This array will have 12 three
axis magnetic field sensor nodes.
Any interested supplier must demonstrate by way of a statement
of capabilities that it meets the following requirements:
Demonstrated knowledge of and experience with sensing array
technology (accoustic, electromagnetic and orientation)
Demonstrated experience, company and key personnel, in the
development of lightweight, underwater digital sensing arrays
that include magnetic and acoustic sensors and the associated
control and data acquisition software.
This procurement is subject to the following trade agreement:
Agreement on Internal Trade (AIT)
Due to absence of competition for technical reasons, it is
proposed to negotiate with Omnitech Electronics Incorporated, 10
Akerley Boulevard, Dartmouth, NS B3B 1J4 for this requirement.
The proposed contractor is experienced in developing prototype
electronic systems including the fabrication of printed circuit
boards, construction of electronic enclosures and programming of
time critical systems. In order to reduce project risk and to
ensure compatibility with a combination electric and magnetic
field sensor node (EM node) capability that is currently being
developed under Contract. W7707-115275/001/HAL, the signature
collection system must use the DRDC Rapidly Deployable (RDS)
serial data bus technology. This technology was developed as
part of the now completed RDS Technology Demonstration Project
and has subsequently been incorporated in the Northern Watch
Technology Demonstration Project Underwater Sensing System
(Contract W7707-088007/001/HAL), the CFAV Quest Onboard Magnetic
Monitoring System (Contract W7707-115237/001/HAL), and the EM
Nodes (Contract W7707-115275/001/HAL). Omnitech Electronics of
Dartmouth, Nova Scotia was the contractor responsible for
developing the RDS data bus technology.
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "only
one person is capable of performing the work".

The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:
Agreement on Internal Trade (AIT) - Article 506:12(2) where
there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exists.

The intellectual property created during the course of any
resultant contract will rest with the Crown. Exception 6.4.2 in
the Treasury Board's Policy on Title to Intellectual Property
Arising under Crown Procurement Contracts is being invoked.

Estimated completion date: December 31, 2012 with an option to
extend to December 31, 2014.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
