2013 National Cadet Marksmanship Championship

1.    ACAN Explanation

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award.

2.    Definition of Requirement

The Department of National Defence (DND), Regional Cadet Support
Unit (Central) at Canadian Forces Base (CFB) Borden, Borden,
Ontario, has a requirement to have an outside contractor provide
Accommodations, Meals and Facility Services to hold the 2013
National Cadet Marksmanship Championship in St. Catherines,
Ontario from 1 May 2013 to 13 May 2013 inclusive. There will be
approximately 137 cadets, 25 coaches and 55 staff members for a
total of 217 personnel who will be involved with the
Championship. The estimated value of the contract is
$130,000.00 (taxes extra).

3.    Criteria for Assessment of the Statement of Capabilities

3.1    Minimum Essential Requirements:

Any interested supplier must demonstrate by way of a statement
of capabilities that it meets the following requirements:

The Contractor must provide the following for the 217 personnel
of the Canadian Forces from May 1, 2013 to May 13, 2013
inclusive:

1.    The facility must be within an 8 km driving distance of the
city hall in St. Catherines, Ontario Canada. The driving
distance is street distance (travel distance by vehicle) and
will be verified using Google Map (http://maps.google.ca). St.
Catherines city hall is located at: 50 Church Street, St.
Catherines, Ontario, L2R 7C2.    

2.    Overnight accommodation must be provided based on the
following dates: up to 39 rooms from 30 April to 3 May 2013;
217 rooms from 4 May to 10 May 2013; and up to 26 rooms on 11
May 2013. All rooms are based on single occupancy (one person
per room).

3.    Overnight accommodation must be located within a 10 minute
walk from the air rifle ranges.

4.    Laundry facilities must be located on each floor where the
overnight accommodations are to be provided (residence building).

5.    Breakfast, Lunch and Supper must be provided for all
personnel for the entire duration of their stay. Final menu
selection will confirmed upon awarding of contract.

Meals comprising of breakfast, lunch and dinner, or any
combination of meals as requested, shall be in accordance with
the Canada Food Guide. The meals must be of high nutritional
value, which will ensure that service members' and/or cadets
undergoing training in the contractor's geographical area of
responsibility, receive the necessary vitamins and calories
required to perform a high level of physical and mental
activity.

The contractor shall, except as otherwise stipulated, provide
all equipment necessary, or desirable, for the fulfillment of
the contractor's responsibilities including, without limitation:
hot-food holding equipment; glassware; dinnerware; cutlery;
utensils; and small ware (of disposable nature) for event site.
Department of National Defence is reliant on the contractor's
experience and skill in determining the suitability of such
equipment for the provision of safe, efficient, and esthetically
pleasing food handling and serving. The contractor is
responsible to ensure that all equipment is kept in a neat,
clean, and sanitary condition at all times.

6.    The Contractor must provide a cafeteria space that can
accommodate up to 217 personnel to dine at the same time.

7.    The Contractor must provide a cafeteria space that is located
within a 5 minute walk of residence building.

8.    The Contractor must provide one (1) gymnasium (approximately
110' x 135' or greater) to be used as the prone air rifle range
between May 4 -11, 2013;

9.    The Contractor must provide one (1) gymnasium (approximately
68' x 100' or greater) to be used as a standing air rifle range
and to conduct concurrent activity from May 4 to May 11, 2013
inclusive. This Gym must be in close proximity (within 50
meters) of the larger gymnasium.

10.    The Contractor must provide three (3) classrooms/conference
rooms from May 4 to May 11, 2013 inclusive, that must be within
50 meters to the prone air rifle range gymnasium to be used as
Team waiting areas.

11.    The Contractor must provide five (5) classrooms/conference
rooms from May 3 to May 10 inclusive, to be used by the
Championship Staff for scoring, statistics, meeting and rooms.

12.    The Contractor must provide one (1) classroom located in the
residence building to be used as an Internet Caf/Coaches meeting
room from May 1 to May 13 inclusive.

13.    The Contractor must provide one (1) Lecture room with
audio/visual (A/V) capability (capacity 250 or more) on May 5,
2013 and May 10, 2013 to conduct the Opening and Closing
ceremonies.

14.    The Contractor must provide a dedicated reception area for
Championship personnel (6 DND staff and approximately 40 cadets
at any one time) located in the same building as the
accommodation. The reception area is for in-clear process which
is a continuous process where cadets and staff are assigned
their rooms and complete some routine administration. Provision
of tables and chairs is optional. The dedicated reception area
is to be available as required on 4 May and 11 May 2013.

15.    Meals must be provided during the following time frame:
Breakfast:    0630 to 0800 hours
Lunch:        1130 to 1300 hours
Dinner:    1630 to 1800 hours

Contractor will be notified 2 days in advance of any change to
the above meal time.

16.    There will be no cost for room cancellation with 48 hours
notice.

4.    Applicability of Trade Agreements

This procurement is subject to the following trade agreements:
Agreement on Internal Trade (AIT)
North American Free Trade Agreement (NAFTA)

5.    Justification for the Pre-Identified Supplier

It has been determined that the 2013 National Cadet Marksmanship
Championship event will be held in St. Catherines, Ontario.
Brock University is the only known source able to accommodate
DND's needs for facilities to be used for prone air rifle range
and standing air rifle range, as well as provide classrooms,
conference rooms, lecture rooms with AV, meals and
accommodations. There is no onther known facility in the
immediate area of St. Catherines that can accommodate DND's
needs within the required time period of 1 May to 13 May 2013
inclusive.

6.    Government Contracts Regulations Exception

The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "Only
one person or firm is capable of performing the contract"; for
patent or copyright requirements, or technical compatibility
factors and technological expertise."

7.    Exclusions and/or Limited Tendering Reasons

The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:

Agreement on Internal Trade (AIT) - Article 506.12 (b) "where
there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exists."

North American Free Trade Agreement (NAFTA) - Article 1016.2
(b), "where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists."

8.    The Delivery Date

Delivery is required from 1 May 2013 to 13 May 2013 inclusive.

10.    Suppliers' right to submit a statement of capabilities

Suppliers who consider themselves fully qualified and available
to provide the goods and services described in the ACAN, may
submit a statement of capabilities in writing to the contact
person identified in this notice on or before the closing date
of this notice. The statement of capabilities must clearly
demonstrate how the supplier meets the advertised requirements.

11.    The closing date for a submission of a statement of
capabilities:

The closing date and time for accepting statement of
capabilities is 14 January 2013 at 2:00 p.m. EST.

Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.
