Nature of Requirements:

ETHICS AND PASTORAL COUNSELLING TRAINING
The Canadian Forces Support Training Group (CFSTG) located at
Canadian Forces Base (CFB) Borden, Ontario have a requirement
for instruction in Centre Intermediate Ethics and Pastoral
Counselling courses. The requirement is for two serials of each
course, one Anglo and one Franco. The requirement is for the
instruction to be taught at an Ecumenical Post-Graduate
Institute which is a recognized Canadian Authority on Ethics and
Pastoral Counselling.

The Ecumenical Post-Graduate Institute must be a fully bilingual
institute that will be able to provide both the teaching and
support services in both official languages of Canada, English
and French. The Ecumenical Post-Graduate Institute must be
located within the National Capital Region to allow the easiest
access to the Departmental Subject Matter Experts who will
instruct Canadian Forces specific subjects. This will
significantly increase their ability to get the right lecturer
when required as a one hour lecture will not mean that loss of
several days of work due to travel distances.

The intent is to have a blended course delivery where both
Canadian Forces and University Subject Matter Experts
co-operatively teaching the required material. Military
personnel are to be enrolled in a university level training
programme that adheres to existing approved pedagogical
practices and standards. Military personnel completing the
programme may be integrated with the regular student population
or be instructed as a homogenous group. It is preferable that
the agency providing the training be recognized as an Ecumenical
diploma/degree granting institution in order to ensure the
training provided to Canadian Forces members is suitably
recognized and transportable to other institutions.

The Canadian Forces Chaplain School and Centre (CFChSC) has
requested to have one bilingual source of training to avoid the
requirement for additional staff to instruct the military
portions of the course and to supervise the students during
their training. As in other trades the Operational tempo has
resulted in critical personnel shortfalls within the Chaplain
Corps. The conduct of this course will realize significant
savings in Courseware development and translation and travel.
These courses are required by all new Chaplains in the Canadian
Forces prior to them being available for deployments areas of
Operations. Due to a critical shortage of Chaplains with these
qualifications it is requested to expedite this request.

The intent is to award a Contract to Université Saint-Paul/Saint
Paul University, 223 Main Street, Ottawa, Ontario K1S 1C4,
Canada (Operating as: Vice-recteur administrative) meeting the
requirements of existing approved pedagogical practices and
standards, in both official languages of Canada, English and
French for Canadian Forces members that will culminate in
student diploma/degree granting which is suitably recognized and
transportable to other institutions.

This requirement has single sourcing provisions in accordance
with Government Contracting Regulations,
Article 10.2.1 para (d) only one person or firm is capable of
performing the contract. Exception (d) sets competitive bidding
aside when only one person or firm can do the job. This
exception is quite definitive and should be invoked only where
patent or copyright requirements, or technical compatibility
factors and technological expertise suggest that only one
contractor exists. This exception should not be invoked simply
because a proposed contractor is the only one known to
management.

Limited Tendering under the Trade Agreements

Since this procurement is subject to the (1) Agreement of
Internal Trade (AIT), (2) North American Free Trade Agreement
(NAFTA), and (3) World Trade Organization Agreement on
Government Procurement (WTO-AGP), the reasons for sole sourcing
are as follows:

(1) Agreement of Internal Trade (AIT) Article 506.12. Para (a)
to ensure compatibility with existing products, to recognize
exclusive rights, such as exclusive licences, copyright and
patent rights, or to maintain specialized products that must be
maintained by the manufacturer or its representative.

(2) North American Free Trade Agreement (NAFTA) Article 1016:
Limited Tendering Procedures para (d) for additional deliveries
by the original supplier that are intended either as replacement
parts or continuing services for existing supplies, services or
installations, or as the extension of existing supplies,
services or installations, where a change of supplier would
compel the entity to procure equipment or services not meeting
requirements of inter changeability with already existing
equipment or services, including software to the extent that the
initial procurement of the software was covered by this Chapter.

(3) World Trade Organization Agreement on Government Procurement
(WTO-AGP) Article XV: Limited Tendering para (d) for additional
deliveries by the original supplier which are intended either as
parts replacement for existing supplies, or installations, or as
the extension of existing supplies, services, or installations
where a change of supplier would compel the entity to procure
equipment or services not meeting requirements of inter
changeability with already existing equipment or services (5).
The period of the Contract is from date of Contract to 31 March
2010 inclusive, with an option to extend the term of the
Contract by up to two additional one year period.

An estimate of the cost of the proposed Contract is between
$350,000.00 and $400,000.00 Canadian Dollars.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
