Q1: In the event of a laboratory hold time exceedance (particularly microbiological sampling), will DTI issue an extra for additional sampling or will the successful bidder be responsible for returning to the site and re-sampling at their own cost?
A1: The consultant is responsible for making sure the samples arrive at the laboratory within the required hold time. DTI will not issue any extra for returning to re-sample unless the delay is caused by unforeseen circumstances outside the consultants control.
Q2: Can you provide us with the definition of "preferential treatment"?
A2: The application of preferential treatment is part of legislation where depending on the applicable trade agreements based on the lowest possible threshold, GNB reserve the right to award to a NB Supplier.
Q3: Can you provide us with the definition of "NB Supplier"?
A3: NB Supplier is defined in the Procurement Act as a supplier that has a place of business in NB.
Q4: How is DTI evaluating whether or not a bidder is qualified to complete this work (i.e. tender indicates that you must meet requirements of the NBDELG Guideline for Management of Contaminated Sites). Does a CV or other documentation (i.e. Project Descriptions) need to be provided as part of the bid?
A4: The engineer / geoscientist proposed for the work must be a member in good standing with the APEGNB. No CV submission is required.

The work under this contract comprises the furnishing of all labour, materials and equipment required to provide Water Sampling and Reporting Services outlined in the attached specification for DTI buildings across the Province.
This contract is for a two (2) month period from November 1, 2020 to December 31, 2020 with the option to be renewed for four (4) additional periods of twelve (12) months upon written agreement by both parties.
OPTION PERIOD PRICING - Pricing shall be subject to negotiation of a satisfactory contract price and should not exceed the tendered price plus any published increase in the New Brunswick Consumer Price Index.
Each building listed in "Appendix A" shall be tested once per period:
- Between the period of November 12, 2020 and December 31, 2020 for the initial contract period.
- Between the months of July and September for each and every subsequent optional renewal period starting in 2021.
Locations: Various Locations throughout New Brunswick. See attached "Appendix A"
Locations in close proximity to each other may be sampled on the same day, if practical to do so.
The bidder shall use the Invitation to Tender Form as their price breakdown sheet indicating their cost per site. Bidders should bid directly on this invitation to tender.

Please ensure to also indicate the total bid price in the "Total Including all charges" space provided. The price bid shall not include HST.
The contract will be awarded to the lowest total compliant bid for all locations. Bidders must bid on all items to be considered for award.
Prior to award, proof of insurance will be required as per Section 7 of the Specifications document.
Given that there is potential for contamination to be identified as a result of testing, Successful bidder to ensure to follow the qualification requirements of the NB Department of Environment and Local Government (NBDELG) Guideline for the Management of Contaminated Sites. The guideline defines a Site Professional as "a person of appropriate qualifications as per the requirements of the Association of Professional Engineers and Geoscientists of New Brunswick (APEGNB)".

Where the estimated value of the goods or services to be procured is below the lowest applicable threshold value of any relevant trade agreement, Service New Brunswick reserves the right to give preferential treatment to a prospective supplier from New Brunswick. Should this right be exercised, the following order of priority will apply: a) firstly, New Brunswick manufacturers if the goods to be procured are manufactured in New Brunswick; and b) secondly, New Brunswick vendors.
When bid submissions are evaluated on price:
- Applicability of the preferences will be determined based on the price differential between the lowest-priced acceptable bid and the bid receiving the preferential treatment.
- The price differential under which a NB supplier preference may be applied will be limited to 10%. When the lowest-priced acceptable bid before preferential treatment is applied is a New Brunswick vendor, the price differential under which a NB manufacturer preference will be applied will be limited to 5%.
- The preferential treatment will be applied by making the award to the NB supplier.
When bid submissions are evaluated on a point system:
- Applicability of the preferences will be determined based on the price differential between the pricing component of the highest scoring acceptable bid submission and the pricing component of the bid(s) receiving the preferential treatment.
- The price differential under which a NB supplier preference may be applied will be limited to 10%. When the highest scoring acceptable bid submission before preferential treatment is applied is a New Brunswick vendor, the price differential under which a NB manufacturer preference will be applied will be limited to 5%.
- The preferential treatment will be applied by allotting a maximum of an additional 5% of the total possible points to New Brunswick manufacturers' total scores and 4% to NB vendors' total scores. If no bid from a New Brunswick manufacturer has been retained for preferential treatment, New Brunswick vendors may receive a maximum of an additional 5% of the total possible points rather than 4%.
The decision to apply a preference will be at the sole discretion of Service New Brunswick. To be eligible, suppliers must meet the definition of NB supplier as identified by the regulation under the
Procurement Act. NB manufacturers should indicate in their bid that they are a NB manufacturer to be considered for the NB manufacturer preference.

Award of contracts: no contract shall be awarded and no payment shall be made to a vendor unless authorized by the Minister or his delegates. The Minister may make an award to the preferred vendor conditional on the negotiation and acceptance of a detailed contract between the Province and the vendor. In such cases, should the detailed contract negotiations not be completed in a reasonable period of time, the Province reserves the right to discontinue negotiations with the vendor and
subsequently enter into negotiations with the second preferred vendor.
No right or duty, in whole or in part, of the vendor under a contract issued may be assigned or delegated without the prior consent of the Strategic Procurement Branch.
Unless the Strategic Procurement Branch has determined otherwise prior to tender closing, all prices must be extended and totaled.
