SCOPE OF THE WORK
The Contractor shall design, manufacture, test, prepare for shipping, load, transport and deliver the ITEMs of Work to the Purchaser on or before the agreed delivery date(s) as per the Technical Requirements and Supplementary Technical Requirements.
The Work may include one or more of the following ITEM(s):
ITEM 1 – Spec ID #1 - three-phase, 12 kV, 2.0MVAr per stage (4.0MVAr per bank) Metal Enclosed Capacitor Bank
The ITEM(s) to be supplied and delivered and compensation agreed under this Contract shall be as set out in Contract Form 1. The Purchaser will endeavour to procure needed ITEM(s) from the Contractor. However, nothing in the Contract prevents the Purchaser, including without limitation in circumstances where the Contractor is unable to provide the Purchaser with needed ITEM(s) within an acceptable timeframe, from contracting with any other person or entity for the purchase of the ITEM(s).
The Purchaser may increase the ITEM(s) weights +/- 5% upon Contractor’s receipt of finalized Purchaser’s Drawings after contract award and shall not constitute grounds for changes to the Contract Price (price per unit weight) of the ITEM(s).
The Purchaser may add quantities of ITEM(s) from the Work as set out in an Extra Work Order. Payment to the Contractor will be based on actual quantities of Work completed and delivered in accordance with the terms of the Contract. Reductions from, or additions to, the estimated quantities shall not constitute grounds for changes in the Contract Price or unit price for any ITEM(s), regardless of the actual amount of variation from the estimated quantities originally set out.
