Project Background
As Ontario’s independent energy regulator, the Ontario Energy Board (OEB) makes decisions and rules to ensure that consumers are treated fairly and that the energy sector is reliable and sustainable. We oversee how energy companies operate to ensure the public interest is served. Our vision is to be a trusted regulator who is recognized for enabling Ontario’s growing economy and improving the quality of life for the people of this province who deserve safe, reliable and affordable energy.

The OEB’s responsibilities include the following, with additional detail provided below:

Set the delivery rates energy utilities can charge
Set the prices that customers pay for the electricity and natural gas that they use
Approve major new electricity transmission lines and natural gas pipelines
Approve corporate changes by energy utilities
License energy companies in the electricity sector and natural gas marketers
Establish and enforce the rules for energy companies operating in Ontario
Monitor the wholesale electricity market and the financial and operational performance of utilities
Develop new energy policies and provide unbiased advice to government
Provide information and tools to help consumers understand the rules that protect them and their responsibilities

The OEB’s objectives, responsibilities and powers are set out in legislation and regulations, including the Ontario Energy Board Act, 1998, the Electricity Act, 1998, the Energy Consumer Protection Act, 2010 and the Municipal Franchises Act. The Minister of Energy issues Letters of Direction outlining expectations with respect to the OEB’s priorities for the coming fiscal year. The OEB performs its mandate through adjudicative hearings and consultation processes.

In the electricity sector, the OEB sets transmission and distribution rates, sets payment amounts for output from Ontario Power Generation Inc.’s nuclear facilities and most of its hydroelectric facilities, and approves the fees that the Independent Electricity System Operator (“IESO”) charges to recover its costs of operating the wholesale electricity markets and maintaining the reliability of the high voltage grid. The OEB also sets the prices that residential and small business customers pay for the electricity that they use, referred to as the Regulated Price Plan.

The OEB licenses most participants in the electricity sector including the IESO, generators, transmitters, distributors, wholesalers, retailers and unit sub-meter providers. OEB approval is required for the construction of most electricity transmission lines longer than two kilometres, as well as for proposed changes in the ownership or control of transmitters and distributors or their assets.

The OEB considers challenges to changes in the IESO’s market rules as well as new or amended reliability standards developed by North American reliability authorities, and hears appeals of certain IESO orders. Through its Market Surveillance Panel, the OEB monitors activities and behaviour in the IESO-administered wholesale electricity markets and issues reports with recommendations for remedial action.

Purpose and Objectives
The objective of this RFP is to establish a Vendor of Record Arrangement to retain consultants with energy expertise to be available for a period of at least five (5) years to provide expert advice to OEB staff on matters falling within the various subject areas set out in Section 2.3. This advice in the form of consultant reports or informal discussions may be used by OEB staff to support the development of regulatory policy or in the development of the evidentiary record in OEB hearings.

Details of the specific Deliverables for each assignment will be finalized at the time of the engagement. The commitment to the general terms and conditions to provide expert advice is for a two (2) year term with an option for three (3) additional one (1) year terms. No volume of work is guaranteed or should be inferred by the successful Vendors.

The VOR is not intended to be a vehicle for replacing existing OEB staff, but rather to supplement internal resources or to meet emerging needs.
