Procurement Act, Service New Brunswick reserves the right to give preferential treatment to a prospective supplier from New Brunswick. Should this right be exercised, the following order of priority will apply: a) firstly, New Brunswick manufacturers if the goods to be procured are manufactured in New Brunswick; and b) secondly, New Brunswick vendors.
When bid submissions are evaluated on price:
- Applicability of the preferences will be determined based on the price differential between the lowest-priced acceptable bid and the bid receiving the preferential treatment.
- The price differential under which a NB supplier preference may be applied will vary between 2.5% and 10% depending on the total estimated value of the procurement, in accordance with the ranges set out in the regulation under the
Procurement Act.
- The preferential treatment will be applied by making the award to the NB supplier.
When bid submissions are evaluated on a point system:
- Applicability of the preferences will be determined based on the price differential between the pricing component of the highest scoring acceptable bid submission and the pricing component of the bid(s) receiving the preferential treatment.
- The price differential under which a NB supplier preference may be applied will vary between 2.5% and 10% depending on the total estimated value of the procurement, in accordance with the ranges set out in the regulation under the
Procurement Act.
- The preferential treatment will be applied by allotting a maximum of an additional 5% of the total possible points to New Brunswick manufacturers' total scores and 4% to NB vendors' total scores. If no bid from a New Brunswick manufacturer has been retained for preferential treatment, New Brunswick vendors may receive a maximum of an additional 5% of the total possible points rather than 4%.
The decision to apply a preference will be at the sole discretion of Service New Brunswick. To be eligible, suppliers must meet the definition of NB supplier as identified by the regulation under the
Procurement Act. NB manufacturers should indicate in their bid that they are a NB manufacturer to be considered for the NB manufacturer preference.

R1. The intent of the contract is that waste from the schools is to be disposed of properly. If green, it goes to green, of blue to blue, if all other then to landfill.
Q2. Would the Province be open to alternative proposals including blue and green carts which would provide a more cost effective method of collection and would comply with the sorting requirements of this tender?
R2. No, dumpster/bins are required as per the Specification.
The closing date has changed to March 11, 2021.

Please note the following vendor questions and responses:
Q1. Pertaining to waste streams, for example Arnold H McLeod has 1 "dry/blue bin" and 1 "green/wet bin" with no garbage/MSW collection service being provided. In what stream is the garbage being collected? Are blue/green streams actually being taken to the landfill and dumped as MSW?
R1. As per the Specification, there should be green and blue bin at every school, and some schools we have added "all other" (mostly high schools and bigger schools). Every school does not have enough space to add additional dumpsters and we either move it internally to another schools dumpster or place a construction dumpster during the summer.
Q2. In the tender , page 2 of 6 , the description for containers states they are to be "capable of separating the wet and dry solid waste". Is this actually a requirement for the tender, since in "Appendix A" the list of containers are wet and dry requirements. Do you need special containers that separate wet and dry in each, or can you use one container for wet and one container for dry ?
R1. One container for wet and one for dry, and--where needed--one for all other waste.
Q3. Will there be an extension to the start date as it will take a couple of months to order new containers that are specially designed with front doors?
R1. We would accept locking doors on front or sides.
The Specification has been updated to reflect the closing date of March 9, 2021.

SCOPE
This Invitation to Tender consists of
solid waste and recycling removal and disposal services for the Anglophone School District - East as per the attached Specification.
The contract(s) shall be for a TWO year term, from April 1, 2021 to March 31, 2023 with the option to renew for TWO (2) additional ONE-year terms upon mutual agreement by both parties.
CONTRACT AWARD CRITERIA
Each compliant Vendor bid will be evaluated on a Unit Price PER ITEM basis.
Vendor(s) submitting the lowest Unit Price bid PER ITEM for ANY of the THIRTY (30) Items--or pairs of schools as per Items #14 and #15--will then be subject to a reference check. Acceptability of the reference checks will be at the sole discretion of ASD-E.
A Contract will not be awarded to a vendor being considered for an award if the required references, proof of insurance, and proof of WorkSafeNB coverage are not received as detailed below. Failure to submit the required documents within 5 business days following the request from GNB will result in the vendor bid being disqualified and the next-lowest compliant bidder will be considered for award for the Item(s) in question.
Notwithstanding the evaluation criteria, the Province reserves the right to award to a single or multiple vendors based upon a combination of vendor's bid price and considerations including: number of Items upon which a Vendor has bid; and the Vendor's 'Additional Discount Without Limitation' value (valid only should the Vendor be awarded ALL Items)--whichever provides the best overall value to the Province. Please see the clause titled 'How to Submit Pricing' below. Best overall value will be
determined at the sole discretion of GNB and all decisions are final.
An award may consist of one, multiple, or all Items.

The two schools within Items 14 and 15 may not be bid upon separately--a bid upon Item 14 and/or 15 is a bid upon the two schools detailed within the respective Item.
