SCALES AND BALANCES - REPAIR
SCOPE
The Department of Transportation and Infrastructure (DTI) is looking to establish a Service Contract for the Maintenance and Repair Services for New Brunswick's Highway Truck Scales.
The services required will include (but are not limited to);
- Testing and calibration of all listed heavy truck scales.
- Repairs and/or Preventive Maintenance services for all listed heavy truck scales.
- Provision and installation of scale parts such as weigh bars, load cells and indicators, as well as ancillary parts.
- Provision of a boom truck, certified test weights and operator
This will be a two (2) year contract with the option to renew for three (3) additional one (1) year periods upon written agreement from both parties.
OPTION YEAR PRICING
Pricing will be subject to negotiation of a satisfactory contract price not to exceed the tendered price plus any published increase in the New Brunswick Consumer Price Index (CPI). If a mutually agreed upon price cannot be reached GNB reserves the right to re-tender, re-award or delete the item(s) in question.
The written renewal application must be received by December 1, for the following option year and must include details on any request for variance(s) from the original contract. (The department will be the sole approver for any changes to the agreement.)
SPECIFICATION REQUIREMENTS
Please refer to the attached Terms & Conditions and Item Descriptions below.
For each location listed in this tender, Bidders are required to submit prices for:
a) Replacement weigh bars and/or load cells
b) Replacement indicators
c) Testing and calibration, and repair services (hourly rates)
d) Supply of boom truck, certified test weights and operator (hourly rates)
The successful bidder shall schedule work in coordination with other vendors, if applicable, for the provision of parts and services in this tender.
REPLACEMENT PARTS
For Avery Weigh Tronix brand scales, all replacement parts such as load cells, weigh bars and indicators, except for ancillary scale parts, must be Avery Weigh Tronix,
or equivalent.
For all other brands of scales, all replacement parts such as load cells, weigh bars, indicators and ancillary scale parts must be the same as the brand of the scale at that location,
or equivalent.
All replacement parts supplied must be compatible with the existing scale components. Parts are to be delivered as and when required for the period indicated at the request of the department.
This contract is also for the regular calibration, service and maintenance of the portable scales used to weigh heavy trucks. The portable scales currently used in New Brunswick are IRD PAT SAW 10C portable scales.
This contract is also for parts and service for all associated components for these scales, including but not restricted to, those in the scale shop and in enforcement staff vehicles.
The bidder must be able to have a technician available on-site at the New Brunswick Department of Transportation and Infrastructure scale maintenance shop in Fredericton for the scheduled testing, calibration and maintenance checks for the heavy truck portable scales, and at other times when repairs, etc. may be required.
Most parts for these heavy truck portable scales are provided under a separate contract; however, the bidder may occasionally be required to provide various miscellaneous parts. All replacement parts supplied must be compatible with the existing scale components. Parts are to be delivered as and when required for the period indicated, at the request of the department.
SCHEDULES
Frequency of testing and calibration of all scales will be 3 to 6 cycles per year. Dates for these calibrations will be provided by NBDTI staff. Repairs will be on an as-required basis.
SUBMITTALS
Bidders should include product information with their bid submission if bidding on an equivalent product.
Bidders should submit the following information with their bid submission:
- Details on the training / certification / accreditation / qualifications that the bidder possesses which qualifies them to provide services for the heavy truck scales.
- Identify how many hours of experience the bidder has in providing services for these heavy truck scales and identify how recent the experience is (i.e. what year(s)).
- Provide information relating to experience the bidder has had testifying in court as to their qualifications for testing and certifying these heavy truck scales. Indicate the most recent year for providing such testimony.
- Bidder shall provide a certificate of recognition (CoR) and a valid letter of good standing showing accreditation to the NB Construction Safety Association's program, or to another equivalent New Brunswick provincial program.
CONTRACT AWARD CRITERIA
This tender will be evaluated and awarded based on the overall lowest compliant bid which meets the required specifications. Bidders
MUST bid on all items to be considered for an award.
The bidder may be required to provide detailed boom truck information on their equipment prior to award and may be subject to inspection by NBDTI and NBDJPS staff to ensure compliance and, may be required to provide proof of insurance.
SERVICE / MAINTENANCE AGREEMENT
The successful bidder will be required to sign the Province's "Service/Maintenance Agreement" before a final contract can be signed.
If no agreement is reached within 30 days of the closing date of the tender, the Province reserves the right to cancel this proposed award and move on to the next compliant bid.
HOW TO SUBMIT PRICING
Bidders are invited to submit their UNIT PRICE--the price for a single product within the Tender Item--under the 'Unit Price Including Discount' column. Bidders should then multiply their unit price by the 'Quantity/Unit' to calculate the 'Extended Price'. The 'Unit Price Including Discount' and 'Extended Price' should NOT include taxes.
All shipping/delivery charges to the various locations
MUST be included in the unit price.

Excluded Jurisdictions
1. In accordance with section 162.1 of Regulation 2014-93 under the Procurement Act, US Bids for this solicitation may be refused at the sole discretion of the Government of New Brunswick. Refused bids will not be returned and there will be no further notification to refused bidders.
2. For the purpose of this section:
2.1 "US Bid" means a bid submission from:
a) a US Entity, or
b) a joint venture, syndicate, partnership or other business combination or cooperative arrangement in combination with a US Entity that is submitted from a Place of Business within the United States of America.
2.2 "US Entity" means
a) a business or professional organization, including without limitation a corporation, partnership, joint venture, professional corporation, limited liability company, sole proprietorship, trust or association or other commercial organization, that is created, established, formed or incorporated in any jurisdiction in the United States of America; and
b) any entity that is owned or controlled by an entity listed in paragraph 2.2(a); and
2.3 "Place of Business" means an establishment where a vendor or manufacturer conducts activities on a permanent basis, is clearly identified by name and is accessible during normal business hours.
Tariffs Price Adjustments
Suppliers should prepare bid submissions based on information and costs known at the time of submission. If the price of any goods included within this solicitation is affected by new, previously undisclosed tariffs or duties implemented after the bid submission period has closed, the awarded supplier(s) may request a price increase from the Government of New Brunswick (GNB) to offset the increased costs (a "Tariff Price Adjustment") as outlined in this section.
Before requesting a Tariff Price Adjustment from GNB, suppliers should first seek refund or relief from applicable federal and provincial/territorial government applicable tariff relief programs.
If the supplier is unable to obtain financial relief or support from federal and/or provincial/territorial governments, suppliers may request a Tariff Price Adjustment from GNB for the affected goods, after providing sufficient evidence that financial relief or support was denied.
Suppliers must substantiate any Tariff Price Adjustment request with supporting information and documentation satisfactory to GNB in its sole discretion, including but not limited to: 1) A detailed description of the goods on which a price increase is sought, the associated HS codes, and the applicable tariffs; 2) Detailed breakdown of how tariffs have impacted the supplier's operations and/or supply chain, including raw materials, production, and shipping; 3) A cost comparison before and after
the tariffs, showing how they directly impact the supplier's pricing, and the supplier's plans to mitigate cost pressures; 4) Evidence demonstrating the supplier's inability to source the goods or substitutes from non-US suppliers, or other factors preventing the sourcing of the goods or substitutes from non-US suppliers (e.g., contractual obligations); and 5) Any supportive or corroborative information, such as communications from the supplier's supply chain or logistics partners, which
confirms the impact of tariffs on the supplier's costs.
Requests for Tariff Price Adjustments should be sent to the contact person on the Purchase Order or Contract. Acceptance of any price increase is solely at the Government of New Brunswick's discretion, and subject to any conditions imposed at the time of approval.
All bids will be deemed to have been submitted in contemplation of the above noted potential adjustments to price. By submitting a bid, each supplier acknowledges that the other suppliers who have submitted bids may obtain a Tariff Price Adjustment in accordance with the requirements noted above, and waives any claim, action or proceeding against GNB relating to a Tariff Price Adjustment to any contract arising from this solicitation.
A bidder must obtain official solicitation documents from a distribution service, authorized by the Minister of Service New Brunswick, in order to submit a bid. The current authorized distribution services are the

In such cases, should the detailed contract negotiations not be completed in a reasonable period of time, the Province reserves the right to discontinue negotiations with the vendor and
subsequently enter into negotiations with the second preferred vendor.
