Environment Canada, Downsview Ontario has a requirement for the supply and delivery of one (1) Dual Quantum Cascade Laser System with an option to purchase one (1) additional system and vacuum pumps.
The firm requirement must be delivered on or before March 31, 2013.
In order for Environment Canada to meet their current obligations under the Clean Air Regulatory Agenda (CARA) they require state-of-the-art capacities in the area of gas analysis.
Environment Canada requires a Dual Quantum Cascade Laser system for the continuous measurement of multiple trace gases in ambient air.
This instrument must be highly sensitive for operation in remote environments and have a fast response time for potential plume studies and for deployment of this instrument on mobile platforms including aircraft.
The instrument will be used in field and lab programs in support of CARA objectives, such as studies in the formation, processing and transformation of atmospheric aerosols in the atmosphere.
The dual-laser quantum cascade laser system must meet the following mandatory specifications:
The system must have a measurement response time of less than 0.5 seconds The system must have thermoelectric cooling The systems operation must not require liquid nitrogen The systems total weight must be equal to or less than 100 kg The system must have high sensitivity for trace gas measurements as outlined below i. Must have precision for HCHO of 0.060 ppb Hz-1/2
ii. Must have precision for OCS of 0.02 ppb Hz-1/2 iii. Must have precision for NH3 of 0.02 ppb Hz-1/2 iv. Must have precision for HONO of 0.150 ppb Hz-1/2 v. Must have precision for HOOH of 0.100 ppb Hz-1/2
This procurement is subject to the following Trade Agreements: Agreement on Internal Trade (AIT), North American Free Trade Agreement (NAFTA) and World Trade Organization Agreement on Government Procurement (WTO-AGP)
The only known supplier of a system meeting the technical specifications required is Aerodyne Research Inc. 45 Manning Road, Billerica, Massachusetts, 01821-3976.
For this reason it is proposed to negotiate directly with them for this requirement.
Single sourcing applies under the following:
-GCR. Section 6d) : Only one person is capable of performing the contract.
-AIT, Article 506.12 b) : where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists.
NAFTA, Article 1016.2 b): Where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
WTO-AGP, Article XV 1b): When, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.
However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
