TITLE: LCM Instrument
Public Works and Government Services Canada (PWGSC), on behalf of Public Health Agency Canada (PHAC), Canadian Science Centre for Human and Animal Health (CSCHAH), intends to negotiate with Life Technologies Inc. for the provision of a LCM Instrument.
DEFINITION OF REQUIREMENT
Public Health Agency Canada (PHAC) has a requirement for a LCM Instrument for biological research.
Life Technologies is the only Supplier who provides an LCM Instrument with an Infrared (IR) laser-enabled, low power gentle laser technology.
This instrument has the ability to preferentially pool regions of cross-sectioned tissue to enhance data recovery of very minute sub-categories, to capture individual cells and damage-prone material smaller than 30 microns.
CSCHAH currently has an LCM Instrument with UV technology. Within the CSCHAH lab, projects require the ability to excise the smallest, most pure cell population possible including precise regions of cerebellum and thalamic neuron bundles for microdissection. In most cases, the project sample size is very low in number and therefore extremely precious, thereby requiring reduction in potential technical variability with the capturing of material with IR-activated adhesive-based cap technology and separating cells of interest by lifting. With an Arcturus LCM Instrument, the tissues are always in control and contact throughout, increasing user confidence regarding true capture and no loss of tissue in dissection process. It is imperative to preserve as much of the cells that are smaller than 30 micron in diameter. This unit will give the user the ability to gently excise tissue, and reducing DNA, RNA and Protein damage when capturing small dissected cells.
The sole distinguishing feature of the Arcturus Veritas LCM is its dual-laser microdissection technology, UV and IR laser technology. Life Technologies owns this IR laser patented technology.
MINIMUM PERFORMANCE CRITERIA / SPECIFICATIONS
Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following mandatory requirements:
Low power near-IR laser
Low microns or less capture-ability
Low technical variability and increased reproducibility Recovery from an individual target cell Microdissection of fluorescently stained or fluorescently labeled samples
JUSTIFICATION FOR PRE-IDENTIFIED SUPPLIER
Life Technologies Inc is the only known supplier that can provide a LCM Instrument that meets all of the mandatory performance specifications.

Government Contract Regulations, Part 1, Section 6(d) only one person is capable of performing the contract.
Government on Internal Trade (AIT), Article 506-12(b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists;
North American Free Trade Agreement (NAFTA), 1016.2(b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;
World Trade Organization Agreement on Government Procurement (WTO-AGP), Article XV(b) when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;

You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.
However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
