1. ADVANCE CONTRACT AWARD NOTICE (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. DEFINITION OF THE REQUIREMENT Wintersteiger is the only company that can provide us a self-propelled plot seeder for agricultural experimentation purposes. It will be delivered in Agriculture and Agri-Food Canada (AAFC) Normandin, Quebec, with two belted cone distributors placed side by side to seed 4 rows plots as well as first set up and training.
For the last 10 years, research activities happening in AAFC Normandin in the field of crop ressources have been expending to the point of having around 5000 to 6000 individual plots of different dimensions to seed each year. Precision seeding of these plots requires a high performance plot seeder to be able to adapt to the different field conditions, the different plant species as well as the different requirements of the research projects.
The AAFC Normandin Research farm has been using the same plot seeder since 1983 and its useful life as come to an end. The steering is broken, the seeding speed is unstable and the wheels supporting the engine in front of the seeder compact the soil in a significant way before the seeds are dropped into the soil. This seeder is not appropriate to seed small seeds like canola, flax or any of the perennial plants. Since all of the soils at the Research farm are of clay type, this seeder causes an excessive compaction which reduces the emergence rate of several species. This seeder was modified over the years and equipped with different parts from Wintersteiger. These parts are still in good shape and could be used as replacement parts when needed. They are one manual slope compensation system worth 1,250$, two belted cones worth a total of 8,500$, two lateral seed distributors worth a total of 1,050$ and two antistatic funnels worth a total of 2090$. To summarize, buying the Wintersteiger self-propelled seeder would give us around 13,000$ worth of spare parts and it would extend the useful life of the equipment.
3. CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIEL REQUIREMENTS)
Any interested supplier must demonstrate by way of a statement of capabilities that its system meets the following requirements:
.1 The seeder does not compact the soil before seeding and a small compaction is happening after seeding with the pressure wheels attached to the discs to insure contact between the seeds and the soil. This is the same system as the commercial seeders used by the farmers.

The frame of the seeder has a track width of 140 to 190 cm with graduated adjustments which gives us a wide range of possibilities when the time comes to choose the space between the rows and the space between the plots.
.3 The wheels, rear and front are narrow (30 and 23 cm wide); this gives us a small space between plots and therefore maximises the use of field space.
.4 It has a 60 steps gear box to accommodate a wide range of planting lengths.
.5 It has two ranges of speeds, one for seeding (0 to 6 km/h) and one for going places (0 to 12 km/h).
.6 The modular design of the seeder allows us to customize the machine for many applications. In our case, we will be able, with a simple modification, to change from seeding two plots of 4 rows at the same time to seeding one plot of 8 rows while keeping the same space between the rows and the same space between the plots which is essential to be able to meet the needs of the different research projects.
.7 The manual slope compensation uses two servomotors to adjust the row unit to the slope conditions of the test field before the seeds go into the belted cone which insures a uniform distribution of the seeds.
.8 Uniformity in the distribution of the seeds is also provided with two different types of antistatic funnels, one for small seeds like alfalfa, clover, canola and flax and one for larger seeds like wheat, barley, oat and soya beans. It is also possible to change two other parts of in the distribution head to reach the same goal.
.9 Being self-propelled, it saves us from buying a tractor.
.10 It has a hydrostatic drive; it is easier to learn how to drive.
.11 The frame can accommodate options like a plot herbicide sprayer and a plot fertilizer spreader.
.12 It has excellent maneuverability because of its compact body and optimum weight distribution. The specially constructed steering and hydraulic steering brakes allow turning on the spot.
.13 The two distribution systems being side by side, only one operator is needed to fill the funnels efficiently.
.14 Its relatively light weight, around 1500 kg, will allow us to transport it on external experimental sites on a trailer we already own. Its towing capacity cannot exceed 2160 kg.
The Wintersteiger self-propelled seeder will help AAFC Normandin raise the bar and highly improve the precision and the quality of our seedings, improve efficiency and productivity, eliminate soil compaction and give us more flexibility in the type of seeds (small to large) we can successfully sowseed.
4. APPLICABILITY OF THE TRADE AGREEMENTS TO THE PROCUREMENT This procurement is subject to the following trade agreements:
.1 Agreement on Internal Trade (AIT)
.2 North American Free Trade Agreement (NAFTA)
5. JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER We believe that the self-propelled plot seeder TC 2700 from Wintersteiger is the only product able to perform the work or comply with government requirements.
6. GOVERNMENT CONTRACTS REGULATIONS EXCEPTION The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - only one person is capable of performing the work.
7. EXCLUSIONS AND/OR LIMITED TENDERING REASONS The following exclusions and/or limited tendering reasons are invoked under the trade agreements specified:
.1 Agreement on Internal Trade (AIT)
Article 506: Procedures for Procurement 12. Where only one supplier is able to meet the requirements of a procurement, an entity may use procurement procedures that are different from those described in paragraphs 1 through 10 in the following circumstances:
(b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists.
.2 North American Free Trade Agreement (NAFTA) - Part Four: Government Procurement - Chapter Ten Article 1016: Limited Tendering Procedures 2. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions:
(b) where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
8. PERIOD OF THE PROPOSED DELIVERY DATE The goods must be delivered no later than March 31st, 2014.
9. COST ESTIMATE OF THE PROPOSED CONTRACT The estimated value of the contract is between $80,000 $ to $130,000 including taxes.

SUPPLIER ' RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
12. CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPABILITIES The closing date and time for accepting statements of capabilities is November 28, 2013 at 2:00 p.m. Eastern standard time (EST).

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.
However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
