An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre identified contractor.

If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met.

Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities. If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.

Provisions in accordance with the Government Contracts Regulations - only one person or firm are capable of performing the contract.

The National Research Council wishes to award a contract to the OEM Group for a refurbishment service our existing Tegal systems. The NRC/CPFC

currently owns four(4) Tegal 901 systems.

Three have been modernized (for supportability reasons)

by Tegal Corporation.

In 2010 the OEM Group acquired all Tegal legacy Etch and PVD products, including the 900-series tool sets.

The OEM Group now owns all of the patents and IP to build new and remanufactured systems.

The OEM Group owns all of the application and license and with each system.

They are the only supplier who can legally provide a software license for the 900 series Tegal etch systems.

In addition, they now offer continued support all of Tegal etch tools with spares, upgrades, service and applications support.

In addition to the sustaining support, The OEM Group also provide continuous product improvements for the 900-series platform, including software revisions, process improvements and new hardware.

2120 W Guadalupe Road, Gilbert Arizona 85233 The level of effort for this contract is: $78,950.00. Contract duration is to commence upon contract signature and terminate no later the March 31st 2014. Contract may be subject to negotiation with the supplier.

IP: There are no IP considerations for this contract.

Suppliers who consider themselves fully qualified and available to provide the services/goods described herein (including the interdependency criteria from a scheduling perspective with other work being done internally that results in, as well as impacts, the timeline alluded to above), as well as with the necessary expertise and appropriate contacts with relevant and major global semiconductor memory device manufacturers for the associated critical market analyses (and understanding of paths to markets), may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice.

The statement of capabilities must clearly demonstrate how the supplier meets all of the advertised requirements.
