Request for Tender (RFT) No. 1791744-25
This Request for Tenders (RFT) is an invitation by the Toronto Police Services (TPS) to the following pre-qualified Suppliers (secured through RFPQ No. 1446565-21) to submit bids for the performance of the Work, as further described in Part 3 - DRAWINGS AND SPECIFICATIONS, and the Contract:

Buttcon Limited
Chart Construction Management Inc.
Elite Construction Inc.
Gen-eer Construction Ltd.
Magil Construction Ontario Inc.

Only Bids received from the Suppliers identified above shall be considered by the TPS.
IMPORTANT: SUPPLIERS ARE ADVISED THAT A SIGNED AND EXECUTED VERSION OF PART 4 – FORM E – NON-DISCLOSURE AGREMEENT, WILL BE REQUIRED PRIOR TO THE RELEASE OF ANY AND ALL CONFIDENTIAL INFORMATION IN RESPECT TO THIS REQUEST FOR TENDER DOCUMENT WHICH FORM PART OF EXPECTED PERFORMANCE OF WORK (SCOPE OF SERVICES).

RFT Timetable
The TPS’s currently proposed schedule for each step in the RFT process is set out in below.
Issue Date of RFT: Wednesday June 4th 2025
Optional Site/Information Meeting: Thursday June 19th, 2025 from 10:00a.m. to 12:00p.m (Toronto Local Time) Refer to Section 1.6 of the RFT for more information.
Deadline for Questions: Friday June 27th, 2025
Final Addendum Released: Thursday July 3rd, 2025
Submission Deadline: Thursday july 10th, 2025 at 13:00p.m. (Toronto Local time)
Bid Validity Period: 120 Business Days
Recommended Award: Monday July 11th, 2025 – Friday July 25th, 2025
Security Background Check: Friday July 25th, 2025 – Friday August 29th, 2025
Anticipated Award Date: Tuesday September 2nd, 2025

Submission Requirements
BIds must be submitted through the MERX Electronic Bid Submission (“EBS”) System (https://www.merx.com/). For assistance in using MERX, please contact MERX directly at 1-800-964-MERX or visit the MERX website at www.merx.com. Uploading large documents may take significant time, depending on file size and internet connection speed. It is strongly recommended that Bidders review the MERX EBS instructions well in advance of the submission deadline and allow sufficient time before the submission deadline to upload documents and finalize their submissions. Bidders making submissions near the deadline do so at their own risk. The determination of whether the Bid is delivered by the submission deadline shall be based on the electronic time and date stamp generated by the MERX EBS System server, whether or not accurate.

Vendors are to submit their Quotation through the MERX EBS System prior to 13:00:00 P.M. (Toronto local time) on Thursday July 10th, 2025.

Mandatory Requirements
Vendors to refer to section 1.3 of the RFT addressing RFT Documents. Additionally, refer to section 1.9 regarding submission of bids, which consist of the following:

Part 4 - Form A - Bid Submission Form;
Part 4 - Form B - Bid Bond;
Part 4 - Form C - Experience and Qualifications Form
Part 4 - Form D - List of Subcontractors
Part 4 - Form E - Non-Disclosure Agreement Form;
Part 4 - Form F - Hazardous Substance Notification Acknowledgement; and
Part 5 - Pricing Form

Only those firms satisfying the mandatory requirements will proceed to Stage 2 of the evaluation process.

Term of the Contract
The selected bidder will be required to execute a contract with TPS for the provision of goods and/or service deliverables and should review the terms and conditions set out to understand the contract being entered into with TPS. It is TPS intention to enter into a contract with only one (1) legal entity. The Toronto Police Service’s expectation is that the Work of the Contract will take no more than 24 weeks to attain Substantial Performance of the Work of the Contract (after the Commencement Date).

Negotiations
The TPS reserves the right to enter into negotiations with any one or more Bidders regarding price, scope of services, or any other term of their applications, and such other agreement or contractual terms as the TPS may require, at any time prior to execution of an agreement, whether or not a notice of intent to develop an agreement has been issued to any Bidder and without reissuing this RFT; and to enter into simultaneous, competitive negotiations with multiple Bidders or to negotiate with individual Bidders, either together or in sequence, and to permit or require, as a result of negotiations, the expansion or reduction of the scope of services or changes in any other terms of the submitted applications, without informing other Bidders of the changes or affording them the opportunity to revise their applications in light thereof, unless the TPS, in its sole discretion, determine that doing so is in the TPS’s best interest; and to discontinue negotiations with any Bidders at any time prior to the execution of an agreement, whether or not a notice of intent to develop an agreement has been issued to the Bidders, and to enter into negotiations with any other Bidders, if the TPS, in its sole discretion, determine it is in the best interest of the TPS to do so.

Non-Exclusivity
The creation of this RFT shall not be a guarantee of exclusivity.
