Right to Cancel
In the event the Province of New Brunswick changes the manner in which the goods specified on this tender are obtained, the Province reserves the right to cancel the contract at any time, with 30 days advance notice to the successful vendor(s). The Province of New Brunswick will not be subject to any penalties or costs associated with contract cancellation.
CONTRACT OF SUPPLY
To be delivered as and when required for the period indicated upon receipt of an official Release under Contract. The Province of N.B. does not guarantee that any amount, make, model, brand, item, part or service will be purchased.

SCOPE
This Tender consists of the
supply and screening of 3,000 tonnes of sand for Winter Maintenance Operations as described within Item 1 and the Specifications attached to this Invitation to Tender.
The contract duration shall be from the Date of Contract Issue to November 7, 2020 with the option to renew for TWO additional ONE-year terms.
If either party chooses not to exercise the option year, the Province of New Brunswick reserves the right to re-tender the applicable location(s). In the event of a contract cancellation within the contract period (excluding optional renewal year), the Province of New Brunswick reserves the right to consider the next lowest compliant bidder or re-tender the location. The Province of New Brunswick does not guarantee a specific volume in the option year.
CONTRACT AWARD CRITERIA
The contract will be awarded by considering not only the cost of supplying, screening and loading the natural or manufactured sand, but also the cost of haulage by DTI or others, to the desired location(s). DTI's haulage rates for Soil,Rock and Aggregate, as of June 2018, will be used for evaluation purposes.
A copy of haulage rates are attached in the Tender Specification.
Please see attached list (Appendix D) of non-compliant pits and locations. DTI will reject any bid containing sand supplied from these pits.
AVAILABILITY DATE AND PRICE
Vendor agrees to provide the 3,000 tonnes of sand on or before November 7, 2020.
If the Supplier does not possess the capability to weigh loaded trucks at the source location, the method of weighing trucks used to determine payment for supply shall be used to calculate payment for loading.
VENDOR QUESTIONS

SUBMITTALS
Paper copies of bids are no longer accepted. Please see the clause below titled "New Bidding Method" for instructions to submit bids.
Interested Vendors should submit their price-per-ton in the "Unit Price Including Discount" column and extend the price by multiplying their price-per-ton by 3,000 and inserting the product into the Extended Price column.
Suppliers who are able to load the material shall submit a price per ton for the service. In the event a Supplier cannot load the winter sand, DTI will make arrangements for the loading.
Interested Vendors shall complete the attached Appendix B to be submitted with their bid. Vendors should include their name and sign Appendix B when submitting.
All insurance requirements, detailed in Appendix C, shall be verified by DTI District staff prior to work starting. See attachment "Insurance Requirements - Appendix C" for details.
If the bid price per tonne to load winter sand is deemed to be excessive by DTI representatives, DTI reserves the right to negotiate the price per tonne. If negotiations between DTI and the Supplier are not successful in reaching a price to DTI satisfaction, DTI shall arrange for the rental of equipment to be used in loading the sand.
QUALITY ASSURANCE
At the discretion of DTI, all sand may be tested for moisture at the source. When testing, DTI will take two (2) samples, one sample from the surface and the other sample from the interior of the pile and each of the two (2) samples will be tested.
The average of the two tests will be used as the final moisture content results.
Moisture content of the sand shall not exceed 5%. DTI reserves the right penalize the Supplier for each percentage point, or part thereof, in excess of 5%.

When bid submissions are evaluated on price:
- Applicability of the preferences will be determined based on the price differential between the lowest-priced acceptable bid and the bid receiving the preferential treatment.
- The price differential under which a NB supplier preference may be applied will be limited to 10%. When the lowest-priced acceptable bid before preferential treatment is applied is a New Brunswick vendor, the price differential under which a NB manufacturer preference will be applied will be limited to 5%.
- The preferential treatment will be applied by making the award to the NB supplier.
When bid submissions are evaluated on a point system:
- Applicability of the preferences will be determined based on the price differential between the pricing component of the highest scoring acceptable bid submission and the pricing component of the bid(s) receiving the preferential treatment.
- The price differential under which a NB supplier preference may be applied will be limited to 10%. When the highest scoring acceptable bid submission before preferential treatment is applied is a New Brunswick vendor, the price differential under which a NB manufacturer preference will be applied will be limited to 5%.
- The preferential treatment will be applied by allotting a maximum of an additional 5% of the total possible points to New Brunswick manufacturers' total scores and 4% to NB vendors' total scores. If no bid from a New Brunswick manufacturer has been retained for preferential treatment, New Brunswick vendors may receive a maximum of an additional 5% of the total possible points rather than 4%.
The decision to apply a preference will be at the sole discretion of Service New Brunswick. To be eligible, suppliers must meet the definition of NB supplier as identified by the regulation under the
Procurement Act. NB manufacturers should indicate in their bid that they are a NB manufacturer to be considered for the NB manufacturer preference.

Payment of invoices is the responsibility of the department or organization to whom the goods are shipped or services are supplied.
Award of contracts: no contract shall be awarded and no payment shall be made to a vendor unless authorized by the Minister or his delegates. The Minister may make an award to the preferred vendor conditional on the negotiation and acceptance of a detailed contract between the Province and the vendor. In such cases, should the detailed contract negotiations not be completed in a reasonable period of time, the Province reserves the right to discontinue negotiations with the vendor and
subsequently enter into negotiations with the second preferred vendor.
No right or duty, in whole or in part, of the vendor under a contract issued may be assigned or delegated without the prior consent of the Strategic Procurement Branch.
Unless the Strategic Procurement Branch has determined otherwise prior to tender closing, all prices must be extended and totaled.
The province of New Brunswick reserves the right to negotiate pricing, value added and other savings opportunities with the successful proponent at time of award and throughout the contract.
