The closing date of the Request for Proposal is changed from May 23 to May 26, 2017, 2 p.m., Eastern Daylight Time (EDT).

(a) Requirement: To manufacture and deliver a high density polyethylene

(HDPE) pre-filter in accordance with the Requirement at

Annex A.

(b) Client : Publics Works and Government Services Canada for the

Maurice-Lamontagne Institute of Fisheries and Oceans

Canada.

(c) Emergency: On April 9, 2017, a section of one of the two seawater

filtration systems, located 2 km off the Maurice- Lamontagne Institute, Mont-Joli, Quebec, Canada,

detached and made the system inoperative. Since this event, the saltwater supply to the experimental basins

of the Institute's research programs is insufficient to

meet the needs of the Department and its various

external collaborators. The consequences of this major

breakdown put in danger the achievement of the

Department's research and science priorities, primarily

for the Quebec region. The sectors affected by this

breakdown include, among others, ecosystem research

programs, aquaculture regulatory programs and climate

change.

(d) Delivery Period: Given the urgency, the pre-filter must be delivered

within a maximum of thirty (30) calendar days after

contract award.

(e) Delivery Site: Port of Quebec 150 Dalhousie Street Quebec, Quebec G1R 4M8 Canada

(f) Trade Agreements: The requirement is subject to the provisions of the

World Trade Organization Agreement on Government

Procurement (WTO-AGP), the North American Free

Trade Agreement (NAFTA), the Agreement on Internal

Trade (AIT), and the Chile, Colombia, Honduras, Korea,

Panama, Peru Trade Agreements with Canada.

Due to urgency, the period for the receipt of tenders is

10 calendar days using limited tendering procedures as

outlined under NAFTA Article 1016 1. and 2. (c) and

Article 1012 3. (c) and WTO-GPA Article XIII 1. d. and

Article XI 4. c.

North American Free TradeAgreement (NAFTA): Article 1016: Limited Tendering Procedures: 1.

An entity of a Party may, in the circumstances and

subject to the conditions set out in paragraph 2, use

limited tendering procedures and thus derogate from

Articles 1008 through 1015, provided that such limited

tendering procedures are not used with a view to

avoiding maximum possible competition or in a manner

that would constitute a meansof discrimination

between suppliers of the other Parties or protection of

domestic suppliers.

2. An entity may use limited tendering procedures in

the following circumstances and subject to the

following conditions, as applicable:

(c)

in sofar as is strictly necessary where, for reasons of

extreme urgency brought about by events

unforeseeable by the entity, the goods or services could

not be obtained in time by means of open or selective

tendering procedures; Article 1012: Time Limits for Tendering and Delivery: 3.

An entity may reduce the periods referred to in

paragraph 2 in accordance with the following:

(c)

where a state of urgency duly substantiated by the

entity renders impracticable the periods in question,

theperiods may be reduced to no less than 10 days

from the date of publication of a notice in accordance

with Article 1010.

World Trade Organization Agreement on Government

Procurement (WTO-AGP):

Article XIII - Limited Tendering: 1.

Provided that it does not use this provision for

the purpose of avoiding competition among suppliers or

in a manner that discriminates against suppliers of any

other Party or protects domestic suppliers, a procuring

entity may use limited tendering and may choose

not to apply Articles VII through IX, X (paragraphs 7

through 11), XI, XII, XIV and XV only under any of the

following circumstances: d.

insofar as is strictly necessary where, for reasons

of extreme urgency brought about by events

unforeseeable by the procuring entity, the goods or

services could not be obtained in time using open

tendering or selective tendering; Article XI - Time-Periods: 4.

A procuring entity may reduce the time-period

for tendering established in accordance with paragraph

3 to not less than 10 days where: c.

a state of urgency duly substantiated by the

procuring entity renders the time-period for tendering

established in accordance with paragraph 3
