1. ADVANCE CONTRACT AWARD NOTICE (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. DEFINITION OF THE REQUIREMENT
The Department of National Resources Canada (NRCAN) has a requirement for the supply of one (1) x shear tester (with time consolidation bench) of granular materials to measure the internal friction angle of the sample and the friction angle between the sample and a metallic surface. The material of the sample to be tested consists of a mixture of oil sand + hydrocarbon solvent. Oil sands ores from several sources and different solvents will be investigated. Samples to be tested are similar in appearance to beach wet sand.
3. CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIAL REQUIREMENTS)
Any interested supplier must demonstrate by way of a statement of capabilities that its product/equipment (as appropriate) meets the following requirements:
M1 = Software with license must be included with offered equipment and must be 100% compatible with the offered equipment, must be 100% compatible with Windows 7 and windows 10, and must be able to prepare the granular samples of oil sand and solvent for the offered equipment to perform the following tests: internal friction angle, friction angle between a metallic surface and the sample M2 = Accessory must be included that is 100% compatible with equipment offered and that must be able to prepare samples for testing after a predetermined consolidation time M3 = the equipment offered must be 100% compatible with the Canadian power outlets, 110-120 V M4 = the equipment offered must be able to measure the internal friction angle of the granular sample material of oil sand and solvent M5 = the equipment offered must be able to measure the friction angle between a granular sample of oil sand and solvent and a metallic surface M6 = All cell materials in contact with the sample (granular material of oil sand and solvent) must be compatible with hydrocarbon solvents M7 = the cell must be able to contain liquid saturated sand particles M8 = Cells must be stainless steel for ease of cleaning and sanitation M9 = the offered equipment must be able to operate with particles that have a size distribution between 1 micron to 1 mm M10 = the offered equipment must be able to operate with particles that have an average diameter 90 microns to 300 microns
4. APPLICABILITY OF THE TRADE AGREEMENT(S) TO THE PROCUREMENT

5. JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER
Dietmar Schulze is the only known company that has developed equipment that can measure the internal friction angle of granular materials and the friction angle between the granular material and a metallic surface. Jenike & Johanson is the only authorized re-seller in North America for the Dietmar Schulze Ring Shear Tester RST-XS.s with Time Consolidation Bench.

11. SUPPLIERS' RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
12. CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPABILITIES
The closing date and time for accepting statements of capabilities is December 18, 2017 at 14:00 MST.

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.
However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
